These Affiliate Program Terms (the "Terms") govern participation in the Legendary Leads referral program, operated by Tri-Johnson Marketing Solutions, LLC, doing business as Legendary Leads ("Legendary Leads," "we," "us," or "our"). By joining the program from inside your Legendary Leads account, you accept these Terms on behalf of yourself and your organisation.
1. Who can join
You must hold a Legendary Leads account in good standing, be at least 18 years old, and have authority to accept these Terms for your organisation. We may decline or remove any applicant at our discretion. Employees and contractors of Legendary Leads are not eligible.
2. How referrals are tracked
You are issued a unique referral code and links that carry it. When someone clicks one of your links, we record the attribution and it stays with the account they create. Attribution is permanent once the account exists — it is not re-assigned if that person later clicks another affiliate's link.
A click is remembered for 90 days. If the person creates an account within that window the referral is attributed to you; if they sign up later without clicking your link again, it is not.
Attribution depends on the referred person's browser accepting our tracking. We do not guarantee that every click is recorded, and we are not liable for referrals lost to browser settings, privacy tools, or a person signing up without using your link.
3. What earns a commission
You earn commission on qualifying subscription payments made by accounts attributed to you. A payment qualifies when it has cleared, has passed the holding period in section 5, and has not been refunded or charged back. Taxes, credits, discounts, one-off fees and pass-through costs (including telephony and messaging charges billed at cost) are excluded from the commissionable amount.
4. Tracks, commission rate and duration
There are two tracks. Referral is the default and is for account holders referring people they know. Partner is for external marketing partners and is offered by us in writing — you cannot join it by applying.
Referral track — a rate that scales
Your rate depends on how many of the accounts you referred are active, paying subscribers right now:
- 20% — fewer than 5 active referrals
- 25% — 5 or more active referrals
- 30% — 10 or more active referrals
The count is live, so the rate moves down as well as up: if a referred customer cancels and your active count drops below a step, future commission is booked at the lower rate. Commission already booked keeps the rate it was booked at — a change never retroactively reduces what you have already earned.
Partner track
Partner accounts earn a flat 30% by agreement, and the ladder does not apply. We may also agree a specific rate with you in writing, which overrides both the ladder and the partner rate for as long as it stands.
Duration
Commission recurs on the first 12 qualifying payments an account makes — about one year on monthly billing. After the twelfth, commission on that account stops.
Your current rate, your active count and the next step up are all shown in your affiliate dashboard. If the dashboard and this page ever differ, the dashboard is the authoritative figure. We may change rates prospectively under section 14; a change never reduces commission already approved.
5. Holding period, refunds and chargebacks
Commission is held for 30 days after the underlying payment before it is approved, which covers the refund and dispute window. If the payment is refunded, disputed or charged back during or after that period, the related commission is reversed. If your balance has already been credited, the reversal is deducted from your next approved commission or from your balance.
6. Getting paid
Referral track. Approved commission is credited to your Legendary Leads account and applied against your own subscription charges. Credit has no cash value, is not transferable, and is not redeemable for money except where required by law. Unused credit is forfeited if your account is closed or terminated.
Partner track. Approved commission is paid in cash by PayPal, cheque or ACH, as agreed with you. A balance must reach $50 before it is paid out; anything below that rolls forward to the next run.
7. Taxes
You are responsible for any taxes arising from your participation. Where required, we may ask for a completed Form W-9 or equivalent before crediting or paying you, and may withhold amounts we are legally required to withhold.
8. How you may promote us
You may share your referral links by personal message, email to people who gave you their address, your own social accounts, your email signature, presentations, and printed material such as QR codes. You may use the marketing copy and images we provide in your affiliate dashboard.
9. What is not allowed
Paid search and bidding
You may not bid on "Legendary Leads" or confusingly similar terms in any paid search or paid social platform, and you may not use our name in a display URL or ad headline.
Unsolicited contact
You may not send SMS or automated calls to anyone who has not given you prior express consent. The TCPA carries penalties per message and there is no exception because the recipient is a business. Every email you send must go to someone who gave you their address, and must carry a working unsubscribe link and a physical mailing address, as CAN-SPAM requires.
Deceptive traffic
No cookie stuffing, forced clicks, redirects, pop-unders, typosquatting, bots, or traffic from sources you cannot describe honestly if we ask.
Incentives
You may not offer cash back, gift cards, rebates or any other consideration in exchange for someone using your link, and you may not distribute coupon or discount codes we did not issue to you.
Self-referral
You may not refer yourself, accounts you control, your other businesses, or a second address belonging to you. This is detected automatically and treated as fraud.
Impersonation
You may not present yourself as an employee, agent, support representative or official spokesperson of Legendary Leads, or register domains, social accounts or business names containing our name.
10. Required disclosure
You must clearly disclose that you earn a commission, close to the link and before someone clicks it. One sentence is enough: "I get a commission if you sign up through this link." In video, say it out loud as well as on screen — a line in the description alone is not sufficient. This is required by the FTC's endorsement guidelines and is your responsibility, not ours.
Links on a site you own
Mark referral links on your own website as sponsored (rel="sponsored"). Unmarked
paid links can carry search-ranking consequences for both of us.
11. Use of our name and materials
We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Legendary Leads name and the logos and marketing materials we supply, solely to promote the platform under these Terms. You may not alter our logo, combine it with your own marks, or use it in a way that implies partnership, endorsement or employment. The licence ends when your participation ends.
12. Claims you must not make
Describe what the platform does, not what it guarantees. Do not promise specific revenue, lead volume, rankings or results; do not state prices or features without checking they are current; and do not claim any certification, affiliation or endorsement that does not exist.
13. Your relationship with us
You are an independent contractor. Nothing in these Terms creates a partnership, joint venture, agency or employment relationship. You have no authority to make commitments on our behalf, and you are responsible for your own expenses, staff and compliance.
14. Changes to the program
We may change these Terms, the commission structure, the tracking method or any part of the program. Material changes take effect on notice to you, and continued participation after that notice is acceptance. We may end the program entirely on reasonable notice; commission already approved at that point is still credited.
15. Suspension and termination
Either of us may end your participation at any time. We may suspend or terminate immediately, and withhold or reverse unpaid commission, if we reasonably believe you have breached these Terms, engaged in fraud, or acted in a way that damages our reputation or exposes us to legal risk. Sections 7, 13, 16, 17, 18 and 19 survive termination.
16. Disclaimers and limitation of liability
The program is provided "as is." We do not warrant that tracking will be uninterrupted or error-free, or that you will earn any particular amount. To the maximum extent permitted by law, our total liability arising out of the program is limited to the commission approved and payable to you in the three months before the claim, and we are not liable for indirect, incidental, special or consequential damages or lost profits.
17. Indemnification
You will indemnify and hold harmless Tri-Johnson Marketing Solutions, LLC and its officers, employees and agents from any claim, loss, liability or expense (including reasonable legal fees) arising from your promotion of the platform, your breach of these Terms, or your violation of any law — including the TCPA, CAN-SPAM and the FTC endorsement guidelines.
18. Governing law
These Terms are governed by the laws of the State of Iowa, without regard to its conflict of law rules. The exclusive venue for any dispute is the state or federal courts located in Black Hawk County, Iowa, and both parties consent to that jurisdiction.
19. Entire agreement
These Terms, together with the Legendary Leads Terms of Service and Privacy Policy, are the entire agreement between us regarding the affiliate program. If any provision is held unenforceable, the rest remains in effect.
